How Immigration works

Step 1: Case Assessment and Signing the Agreement with Legal Professionals

Before applying for a visa or deciding to immigrate, confirm your eligibility by having your case professionally assessed. After confirmation and before proceeding any further, hire and sign an agreement with your legal representative introduced by Maxcan Immigration. This agreement will outline the legal fees and consultant’s responsibilities for your immigration.

Step 2: Complete Application Forms and attach required documents

With the help of your immigration consultant, complete the application forms and attach all the required documents related to your case. Your consultant will provide you with the complete list of required documents. More often than not, more documents may be recommended to provide in order to strengthen your application.

Step 3: Application Submission to Visa Office

Before submitting your application to the correct visa office, your consultant will properly review and organize all the documents. Your consultant will also provide a legal submission letter in support of your application. You will need to pay your immigration processing fee before submission.

Step 4: You may be called for an Interview

Depending upon your case, you may be called for an interview with a visa officer. You will be notified about interview’s date and time. Consult your legal immigration advisor, he/she will prepare you for the interview

Step 5: Written notification about acceptance or refusal

After analyzing your application (including interviews in some cases), the visa office will send you a written letter notifying you of approval or refusal.

Step 6:

If your application is accepted, get ready to visit, study, work or living in Canada! But, in case of refusal, consider your options to appeal the decision. Don’t delay because there are usually deadlines to file an appeal.

I can do it myself, then why should I hire a professional?

There are stories all around about people who successfully handled the immigration process alone. Also, there are stories about people whose visa application got rejected because they did some mistakes on their own. You should consider them as stories only. Every case has different complexities and needs to be handled differently to achieve success.

We suggest you should hire a legal representative and minimize the risk of rejection. Do not play the gamble of going on your own because:

  1. The immigration laws are very complex and constantly change.
  2. Your basic knowledge to apply for a visa does not make you experienced enough to deal with all the complex issues that may arise in your case.
  3. Even successfully getting a visa on your own doesn’t ensure that you have not framed any problems that may affect you in future. The acceptance may turn out to be rejection.
Is there a difference between an immigration consultant and an immigration lawyer?

It is necessary to have some knowledge about immigration process by which you can avoid being a victim of corruption or fraud. There are some fake people who represent them as professionals and cheat innocent visa applicants. So, again, educating yourself about the immigration process will help you. You will encounter two types of immigration representatives during the visa process. They are:

  • When it comes to practicing immigration law, the major differences between an immigration lawyer and an immigration consultant are their credentials and services.
  • Lawyers are graduates from law school. They study various areas of law at the law school. Some lawyers choose immigration law as their practice area after writing the bar exam, so they become immigration lawyers. Whereas, immigration consultants study 6 to 12 months specifically on immigration law at a credited learning institution. They need to pass a national exam before they receive their license.
  • Lawyers and consultants offer most of the same administrative applications services. However, lawyers can represent a client in federal court, and a consultant can only go up to the tribunal level for appeals. But in reality, not all lawyers are interested in the federal court cases and not all consultants like to go to the tribunals either.
  • When it comes to each individual lawyer or consultant, what truly differentiate them from others are not their titles, but their experience, expertise, ability to apply the law to each unique case and their empathy to their clients. As a client, you should ask a lot of questions to find the right lawyer or consultant to best advance your case.

Mostly, application forms have the instructions in which list of documents required for an application are mentioned. Is it true that, even when whole family receives permanent resident visas, only one member can come to Canada first and others afterward?

You may or may not be aware that every permanent resident visa has a validity date. You need to enter Canada before the validity expires. The principal applicant and accompanying family members should come to Canada together to complete the landing procedure. The granting of permanent residence may be deterred if the principal applicant and the family members arrive at different times.

I apply for both work visa and permanent resident visa simultaneously?

Yes, you can apply for both simultaneously. However, you need to satisfy Immigration Canada your intention to leave Canada – after the expiry of your work (employment) visa.

Do I need to visit Canada before applying for immigration?

The applicants who apply under skilled worker class are not required to visit Canada before applying for immigration. For potential business immigrants, it is always advised to visit Canada before buying or establishing a business or making an investment to an existing company in Canada.
